‘Terms & Conditions’
All of EMC’s Services, such as;
Consultations, Marketing Plan Developments, Market Focus Research and Analysis, Market Focus File Developments, Online Presence Establishments and Optimizations, Website Fire-Ups and Enhancements, Direct Marketing Campaigns, Ongoing Promotional Campaigns and Other Related Services, Account Fire-Ups on Video Networks and Social Networks, Ad Copy and Article Writing, Production of Videos, Power-Points and Slide Show Marketing Tools, Account Uploads and Various Account Maintenance and Enhancement Services, are here forth referred to as ‘Work’.
All Work is carried out by an hourly rate and pre-estimated time frame, (unless discussed, agreed upon and specified differently on invoicing).
Special Notice Regarding Account Fire-Ups:
You will be sent an email notification upon commencement and upon completion of the Fire-Up process so you may marvel at your newly established web presence location and for your review of the profile and personal information, video’s or power-point’s descriptions, accuracy of web-links and overall content, in the event that revisions are required or small changes are then preferred.
Invoicing:
All Work requiring 6 hours or less for fulfillments, which is commissioned and invoiced as such, must be paid in full prior to commencements.
All Work requiring 6 hours or more for fulfillments, which is commissioned and invoiced as such, may be payable in full or payable in partial payments, ( as invoiced ), for any commencements.
For All Quoted Work Requiring 6 Hours or More:
A deposit of 50% of the invoiced estimate will be required to be received by EMC before any of the work commences; you will also be given advance notice of a time-estimate for a completion date and time. The remaining balance will need to be paid in full and be received by EMC upon the final stages of the works completion.
You will be sent an email notification with an invoice for the remaining balance and called by phone immediately thereafter to inform you that the work is finished for your review and receiving.
Upon receipt of final payment, EMC will immediately release all unreleased account command codes or send over any purchased production materials due to you.
Special Notice Regarding Electronic Payments
Payments made electronically must be paid in the exact invoice amount. Only one invoice can be cleared per transaction. Exceptions are made only by request and agreed upon between client and EMC.

Special Notice Regarding Late Fees and Breech of Agreement
Late Fees for Accepted and Unmade Payments on ‘Multiple Job Invoices’
Work will not proceed if invoices remain unpaid. Failure to pay an ‘overdue’ invoice longer than one month from the original invoiced date, will result in a 10% added surcharge on any amount over $100.00 and will result in a 20% added surcharge on any amount over $500.00.
Going Beyond Three Months Overdue Is Regarded as Breech of Agreement
Accounts established or design and production work not paid for may be destroyed after 3 months time, from initial invoice date, and can potentially result in the ensuing of legal proceedings. Any and all legal proceedings deemed as necessary would take place in the state of Florida wherein services were rendered.
EMC reserves the right to terminate any business relationship if the above procedures have not been met; no refunds will be given for any work carried out.
Until contract is completed and paid for in full, all design work remains the intellectual property of Vito A. DeLiso and EMC.
Cancellation by the client of work already commenced will result in a cancellation charge based on the approximate time spent on the work.
Work requested either verbally or written constitutes acceptance of these ‘Terms & Conditions’.
These ‘Terms and Conditions’ are listed publicly as of July 2008. EMC reserves the right to change the above terms and conditions at any time. In the unlikely event that changes are made, all clients will be given notice prior to posting by email to the email address on record.
